Acceptance of Terms and Conditions:

By requesting work from CFGD, all clients acknowledge and agree to abide by the terms and conditions outlined herein.

These terms and conditions govern the relationship between CFGD and its clients and supersede any previous agreements or arrangements.

Clients are encouraged to review the terms and conditions carefully and raise any questions or concerns with CFGD before commencing work.

Continued engagement with CFGD, including requesting work, constitutes acceptance of these terms and conditions in their entirety.

CFGD reserves the right to update or modify these terms and conditions at any time, with changes communicated to clients in advance.

It is the responsibility of clients to familiarize themselves with the most current version of the terms and conditions, accessible on the CFGD website or upon request.

Confidentiality:

CFGD is committed to maintaining strict confidentiality regarding all client relationships, project details, and sensitive information shared during the course of business.

Any information disclosed by clients to CFGD, including but not limited to project briefs, strategies, proprietary data, and personal details, will be treated with the utmost confidentiality.

CFGD will not disclose, share, or distribute any client information to third parties without explicit consent, unless required by law or for the purpose of fulfilling contractual obligations.

All employees, contractors, or third parties engaged by CFGD will be bound by confidentiality agreements to ensure the protection of client information.

Clients can rest assured that their privacy and confidentiality are of paramount importance to CFGD, and every effort will be made to safeguard their information from unauthorized access or disclosure.

Proofreading Responsibility:

The client acknowledges that they are responsible for thoroughly proofreading all print projects before providing final approval for production.

By signing off on a print project, the client agrees that they have reviewed all content, including text, images, and design elements, and accept responsibility for any errors, omissions, or inaccuracies present in the final product.

Any changes requested by the client after the final approval has been given may result in additional charges and delays in production, and the company shall not be held liable for any such changes.

The company shall not be responsible for any errors, including typographical, grammatical, or design-related errors, that are present in the final printed materials once the client has provided final approval for production.

It is recommended that the client carefully review all proofs provided by the company and seek assistance from professional proofreading services if necessary to ensure accuracy before providing final approval.

In the event of a dispute regarding the accuracy of printed materials, the client acknowledges that the company’s records of final approval shall be considered conclusive evidence of the client’s acceptance of responsibility for any errors.

Professional Expertise and Conduct:

CFGD is a First Class BA Hons graphic designer with over 13 years of experience working with global and national clients, possessing extensive knowledge and expertise in the field.

The advice provided by CFGD is professional and offered with the intention of contributing to the success of the project, drawing upon years of experience and industry insight.

Any attempt to undermine CFGD’s professional abilities or expertise will be considered project sabotage and will be addressed accordingly.

In the event of behaviour undermining CFGD’s abilities persisting and not being resolved, CFGD reserves the right to terminate the project without refund.

Ethos and Client Selection:

CFGD operates with a solution-focused ethos, aiming to deliver high-quality services and solutions to clients in a professional and collaborative manner.

CFGD reserves the right to decline working with individuals or entities engaging in behaviours that may undermine or sabotage projects.

Behaviours deemed as project sabotage include but are not limited to deliberate interference with project timelines, deliverables, or communication channels, as well as actions that jeopardize the successful completion of the project.

Clients who exhibit such behaviours may have their projects terminated, and CFGD reserves the right to refuse further collaboration with them.

CFGD values respectful and productive partnerships and expects all clients to conduct themselves accordingly, fostering an environment conducive to successful project outcomes and mutual satisfaction.

Content Generation and Client Responsibility:

If content is not provided by the client within the agreed-upon timeframe, CFGD reserves the right to generate content on behalf of the client to ensure project progress.

The client acknowledges that any content generated by CFGD will be provided for review and approval. The client is responsible for thoroughly checking the content and offering amendments or corrections where necessary.

Once the content generated by CFGD is approved by the client and published or made public in any form, the client agrees to retain full responsibility for its accuracy, legality, and compliance with relevant regulations or standards.

CFGD shall not be held liable for any errors, inaccuracies, or legal issues arising from the content generated on behalf of the client, once it has been approved and made public by the client.

Professional Standards and Project Selection:

CFGD maintains high moral and ethical standards in all aspects of business operations and project engagements.

CFGD reserves the right to refuse any projects that may compromise or conflict with these moral and ethical standards, as determined at the discretion of CFGD.

Projects that involve content, themes, or objectives deemed to be in conflict with CFGD’s professional standing or ethical principles may be declined.

Clients are encouraged to discuss project details openly and transparently with CFGD to ensure alignment with CFGD’s professional standards and values.

CFGD’s decision to refuse a project on moral or ethical grounds is final and not subject to dispute.

Project Timescales and Priority:

CFGD values all clients equally and is committed to delivering projects in a timely manner.

Clients are encouraged to communicate any time-sensitive requirements or deadlines when requesting CFGD’s assistance.

While CFGD strives to accommodate all projects promptly, indicating time sensitivity allows CFGD to prioritize accordingly and ensure timely delivery.

Clients should provide clear and realistic deadlines for their projects, taking into account the scope of work and any specific requirements.

CFGD will make every effort to meet agreed-upon deadlines, but clients are advised to allow sufficient time for project completion and revisions.

In the event that a project requires expedited or rush delivery, additional charges may apply, and this will be communicated to the client in advance.

CFGD will communicate openly and transparently with clients regarding project timelines and any unforeseen delays or challenges that may arise.

Hourly Rate and Billing Structure:

CFGD charges a standard hourly rate of £45 for all services provided, including design, consultation, and other project-related activities.

Billing is calculated in 20-minute intervals, allowing for flexibility and affordability, particularly for small businesses with minor or occasional requests.

Clients will be billed for the actual time spent on their project, rounded up to the nearest 20-minute increment.

The hourly rate and billing structure will be communicated to the client in advance, and any changes to the pricing will be agreed upon mutually by both parties.

Clients will receive detailed invoices outlining the services provided, the time spent on each task, and the corresponding charges.

Payment terms and methods will be agreed upon prior to the commencement of the project, and invoices are payable within [insert payment term here, e.g., 30 days] from the date of issuance.

Exceeding Estimated Time:

While CFGD endeavors to provide accurate estimates for project timelines, unforeseen circumstances or changes in project scope may result in additional time being spent on a project.

In the event that the time spent on a project exceeds the initially estimated amount, CFGD will notify the client promptly and provide a revised estimate for approval.

Any additional time spent on the project beyond the estimated amount will be billed at the standard hourly rate of £45 per hour, unless otherwise agreed upon in writing.

CFGD will make every effort to minimize additional time spent on projects and will communicate openly and transparently with clients regarding any deviations from the estimated timeline.

Clients are encouraged to provide timely feedback and information to facilitate efficient project completion and avoid unnecessary delays.

By engaging CFGD’s services, clients acknowledge and accept the possibility of exceeding the estimated time and agree to pay for any additional time spent on their project at the agreed-upon rates.

Emergency Projects Rate:

Overnight emergency projects, defined as those requiring immediate attention outside of regular business hours, are subject to a higher hourly rate.

The hourly rate for overnight emergency projects is £55 per hour, effective from the time of engagement until project completion.

Clients requiring overnight emergency assistance must communicate the urgency of their request explicitly to CFGD.

CFGD will make every effort to accommodate overnight emergency projects promptly, subject to availability.

Clients will be informed of the additional charges for overnight emergency projects before work commences, and explicit consent will be obtained.

Payment for overnight emergency projects is due upon completion and will be invoiced separately from standard projects.

Time Delays Clause:

As a sole proprietorship, CFGD operates as a one-person outfit, managing all aspects of the design process independently. While every effort is made to deliver projects promptly and within agreed timelines, it is acknowledged and agreed upon by both parties that certain factors may lead to delays beyond CFGD’s control.

Factors contributing to potential time delays may include, but are not limited to:

Workload: CFGD may have multiple ongoing projects at any given time, which could impact the availability and scheduling of new projects.

Unforeseen Circumstances: Unexpected personal or professional circumstances, such as illness, family emergencies, or technical issues, may arise, affecting CFGD’s ability to work on projects as planned.

Complexity of Projects: Projects of greater complexity or scope may require additional time for thorough planning, research, design iterations, and revisions.

Client Responsiveness: Timely feedback, content provision, and approvals from the client are essential for project progression. Delays in client responses may consequently extend project timelines.

While CFGD endeavours to communicate any anticipated delays promptly and maintain transparent communication throughout the project duration, clients are encouraged to discuss project timelines and deadlines during the initial consultation phase to establish realistic expectations.

In the event of any anticipated or unforeseen delays, CFGD will make reasonable efforts to mitigate the impact on project timelines and ensure the timely completion of deliverables to the best of their ability.

By engaging CFGD for design services, clients acknowledge and accept the possibility of occasional time delays due to the nature of operating as a one-person outfit, and agree to exercise patience and understanding in such circumstances.
